All commercial operations carried out by our company Uniqka Design are subject to these general conditions of sale. Unless proven otherwise, the data recorded by the company constitutes proof of all transactions. Validation of the order by the Customer implies unreserved acceptance and acceptance of these conditions, which are accessible at any time on the website and will take precedence over any other document. We reserve the right to modify these terms and conditions at any time. In this case, the applicable conditions will be those in force on the date of the Customer's order.

Preamble

1.1 Scope of the General Terms and Conditions of Sale

These general terms and conditions of sale (hereinafter referred to as "GTC") apply to any purchase made remotely on the website https://www.uniqka-design.fr (hereinafter referred to as "the Site"). The GTC apply concurrently with the Privacy Policy applicable to any user of the Site.

The Site is published by the company HORIZON INTERIOR'S, a simplified joint-stock company with a capital of €1000, registered with the Paris Trade and Companies Register under number B 912 079 035, whose registered office is in Paris (75017) at 35 rue Guy Môquet.

Uniqka Design offers for sale on its Site or by telephone, indoor and outdoor furniture for the home (hereinafter referred to as the "Product(s)") to the customer (defined below) who wishes to make a remote purchase from Uniqka Design (hereinafter referred to as "the Customer"). The Products are marketed under the brand "Uniqka Design," owned by Uniqka Design. The Customer must be a natural person and have the legal capacity to contract and act as a consumer, that is, a natural person who acts solely for the satisfaction of their personal needs. By placing an order remotely with Uniqka Design, the Customer declares that they meet the conditions mentioned above and, in particular, do not make remote purchases of Products for the purpose of reselling them regularly or as part of a professional activity.

1.2 Scope and Acceptance of the General Terms and Conditions of Sale

These general terms and conditions aim to define the terms of sale between Uniqka Design and its Customers, from order to delivery, including the use of services provided by Uniqka Design and payment. They govern all the steps necessary for placing the order and ensure the follow-up of this order between the Parties. If the present terms differ depending on the quality of the Customer, individual or company, these differences will be clearly mentioned.

The Customer undertakes to read the GTC carefully before any order and accepts the GTC by clicking on the order validation button.

2. Products Offered

2.1 Availability

The Products defined on our website (www.uniqka-design.fr) are offered within the limits of available stocks; in fact, Uniqka Design works depending on the products, either based on a tight inventory or direct orders from its suppliers. Therefore, depending on the cases, the Products are available within the limits of Uniqka Design's stocks or subject to the availability of its suppliers' stocks. In case of stock shortage or unavailability of a Product, this is specified on the product sheet. The Customer is informed by Uniqka Design of the availability of the Product(s) and the delivery times when placing the order. Delivery times are clearly stipulated on each product sheet and also during the order process and finally in the order summary. If the Customer orders multiple products with different delivery times, the delivery time of the product with the longest restocking time will be chosen.

2.2 Out-of-Stock Product

If despite Uniqka Design's efforts, the Products ordered by the Customer are no longer available, Uniqka Design will inform the Customer by email or phone as soon as possible. In this case, if the Customer has already paid for the order, Uniqka Design commits to refund the Customer for the portion of the payment corresponding to the unavailable Products if the Customer wishes to cancel those products. Otherwise, Uniqka Design will retain the full payment of the order and commits to inform the Customer of the restocking times for the missing products.

2.3 Product Information

In accordance with Article L.111-1 of the Consumer Code, the Customer can, prior to their order, take note of the characteristics of the Products they wish to order. The Customer must refer to the description on each Product sheet to know the essential characteristics. In accordance with Article L.111-1 of the Consumer Code, Uniqka Design strives to present the essential characteristics of the products as accurately as possible on the technical data sheets of the products. Uniqka Design reserves the right to modify the characteristics of the Products based on the constraints of its suppliers. The information and characteristics are those provided by the suppliers. Uniqka Design is in no way responsible for incorrect data transmitted by the manufacturers. The photographs and graphics presented on the sites or in emails sent by Uniqka Design are for illustrative purposes only and are mainly those provided by the suppliers. In particular, the difference in perception of shapes and colors between the photographs or graphics presented and the Products does not engage the responsibility of Uniqka Design. Uniqka Design will make every effort to ensure that the photographic representation of the products on the website www.uniqka-design.fr is as accurate as possible. However, it is possible that the perception of the Products does not fully correspond to the Products themselves. The Products are sometimes presented in photographs with other products. The description will mention what is and is not included with the Product.

2.4 Prices

The prices of the products on the website www.uniqka-design.fr are indicated in euros, including all taxes, excluding shipping costs. They take into account the VAT applicable on the day of the order. Any change in the applicable VAT rate may be reflected in the prices of the products after the new applicable rate comes into effect. The applicable VAT rate is a percentage of the value of the goods sold: 20% for delivery in Mainland France, Corsica, and Monaco. The eco-contributions are clearly indicated separately and in accordance with the legislation in force on the product sheets.

The prices of Uniqka Design's suppliers are constantly evolving, so the prices displayed on the sites may be modified at any time. They may also vary for reasons of promotional offers or sales. All prices are subject to obvious typographical errors or purely material errors in computer labeling. The applicable price is the one indicated on the Uniqka Design website at the date of order registration by the Customer.

3. Orders

3.1 Order Process

Orders are placed directly on the Site. The Customer follows the order process as indicated on the Site. This process consists of the following steps:

  1. The Customer selects the Product(s) they wish to order.
  2. The Customer verifies the details of their order (product, quantity, price, etc.).
  3. The Customer provides the information required for delivery and invoicing.
  4. The Customer selects their payment method.
  5. The Customer confirms their order and payment.

3.2 Order Confirmation

Once the order is validated, Uniqka Design acknowledges receipt to the Customer by sending an order confirmation email. This confirmation mentions the essential characteristics of the ordered Products, the total price of the order including VAT, and the expected delivery times. The order confirmation email serves as a sales contract between Uniqka Design and the Customer.

3.3 Order Modification and Cancellation

The Customer has the possibility to modify or cancel their order until the order is shipped. Any request for order modification or cancellation must be addressed to Uniqka Design's Customer Service by email or phone. If the order has already been shipped, the Customer will have to follow the return procedure as outlined in Article 7 of these GTC.

4. Payment

4.1 Payment Methods

The Customer can pay for their order using one of the following payment methods:

  • Credit card (Visa, MasterCard, American Express)
  • PayPal
  • Bank transfer

Uniqka Design reserves the right to add or remove payment methods at any time.

4.2 Payment Security

All transactions made on the Site are secure. Payment details are encrypted and transmitted directly to our payment providers. Uniqka Design does not store any banking information.

4.3 Payment Confirmation

The order is considered confirmed upon receipt of the full payment by Uniqka Design. Uniqka Design reserves the right to refuse or cancel any order in case of payment issues or fraud suspicion.

5. Delivery

5.1 Delivery Methods

Uniqka Design offers different delivery methods, including standard delivery, express delivery, and pick-up at designated locations. The available delivery methods are displayed during the order process.

5.2 Delivery Times

Delivery times vary depending on the selected delivery method and the destination. Estimated delivery times are provided during the order process and in the order confirmation email. Uniqka Design makes every effort to respect the indicated delivery times but cannot be held responsible for delays due to external factors (e.g., carrier issues, customs clearance).

5.3 Delivery Costs

Delivery costs are calculated based on the weight and dimensions of the ordered Products and the selected delivery method. These costs are clearly indicated during the order process and in the order confirmation email.

5.4 Delivery Tracking

The Customer receives a tracking number by email once the order is shipped. This tracking number allows the Customer to follow the delivery status of their order on the carrier's website.

5.5 Delivery Issues

If the Customer notices any issue with the delivered Products (e.g., damaged packaging, missing items), they must inform Uniqka Design's Customer Service as soon as possible. The Customer may be asked to provide photos or additional information to facilitate the resolution of the issue.

6. Withdrawal Right

6.1 Conditions

In accordance with Article L.221-18 of the Consumer Code, the Customer has a withdrawal period of 14 days from the receipt of the Products to exercise their right of withdrawal without having to justify their decision or bear any costs, except for the return shipping costs.

6.2 Procedure

To exercise their right of withdrawal, the Customer must notify Uniqka Design of their decision by email or using the withdrawal form available on the Site. The Customer must then return the Products in their original condition and packaging, along with the purchase invoice, to the address provided by Uniqka Design.

6.3 Refund

Upon receipt of the returned Products, Uniqka Design will proceed with the refund of the purchase amount, excluding return shipping costs, within 14 days. The refund will be made using the same payment method used for the order.

7. Warranty

7.1 Legal Warranty

The Products sold by Uniqka Design benefit from the legal warranty of conformity and the warranty against hidden defects, in accordance with Articles L.217-4 to L.217-14 of the Consumer Code and Articles 1641 to 1649 of the Civil Code.

7.2 Manufacturer's Warranty

Some Products may benefit from an additional manufacturer's warranty. The conditions and duration of this warranty are specified in the product description on the Site.

7.3 Warranty Claims

To benefit from the warranty, the Customer must contact Uniqka Design's Customer Service and provide proof of purchase and a detailed description of the issue. Uniqka Design will then inform the Customer of the steps to follow.

8. Liability

Uniqka Design cannot be held liable for any indirect damages resulting from the purchase of the Products. In any case, Uniqka Design's liability is limited to the amount of the order.

9. Personal Data

9.1 Data Collection

Uniqka Design collects personal data from Customers to process orders and manage the customer relationship. This data is necessary for the execution of the contract and is intended for Uniqka Design and its service providers.

9.2 Data Protection

Uniqka Design implements appropriate technical and organizational measures to protect the personal data of Customers against unauthorized access, alteration, or destruction.

9.3 Customer Rights

In accordance with the Data Protection Act of January 6, 1978, as amended, and the General Data Protection Regulation (GDPR), the Customer has the right to access, rectify, and delete their personal data. The Customer can exercise these rights by contacting Uniqka Design's Customer Service.

10. Intellectual Property

All content on the Site (texts, images, logos, etc.) is the property of Uniqka Design or its partners and is protected by intellectual property laws. Any unauthorized use of this content is strictly prohibited.

11. Databases

The databases established by Uniqka Design are protected by copyright as well as by the law of July 1, 1998, transposing into the Intellectual Property Code the European Directive of March 11, 1996, on the legal protection of databases. Without written permission from Uniqka Design, any reproduction, representation, adaptation, translation, and/or modification, in whole or in part, as well as any substantial qualitative or quantitative extraction to another website, is prohibited and sanctioned by Articles L.343-4 and following of the Intellectual Property Code.

12. Disputes

This contract is subject to French law. The choice of applicable law is only valid insofar as it does not deprive the Client of the protection conferred, where applicable, by the mandatory provisions of the country where they have their habitual residence. The French version of the GTC shall prevail over any other version translated into another language. In the event of a dispute, the Client must first contact Uniqka Design to seek an amicable solution by means of a written complaint by email to: contact@uniqkadesign.fr.

In accordance with the provisions of Articles L 611-1 and R 612-1 and following of the Consumer Code concerning the amicable settlement of disputes: When the consumer has sent a written complaint to the professional and has not obtained satisfaction or a response within two months, they may submit their complaint free of charge to the consumer mediator. The mediator must be contacted within a maximum of one year from the initial complaint.
